Unless there is something pretty surprising that we do not know from the report, it is inconceivable that there can be any justification to bring disciplinary proceedings against a solicitor for carrying out the lawful instructions of his client. The SRA certainly has no right to spend the profession's money on transparently hopeless cases. One would think that a wasted costs order against the SRA board personally would be an appropriate outcome if the ultimate judicial determination is that there could never have been a case to answer.
