As a compliance adviser to a large number of smaller firms, I nearly choked on my coffee when I read this. As luck would have it, I have recently been specifically discussing leasehold advice procedures with a number of my firms and it is something they ALL do as a matter of course.

I therefore have to question the constitution of the SRA's sample of firms because it is so at odds with my (admittedly anecdotal) experience. Was it a random sample or was there a predominance of 'high-risk' and/or conveyancing factories among them? If there was, selecting a skewed sample then dressing it up as a profession-wide crisis is highly irresponsible.

I'd rather the SRA directed its underlings to look at the real elephant in the conveyancing living room - referral fees.
