If I were HHJ Simpkiss I would be well and truly miffed at this appeal decision. Unnecessarily undermined by the higher Court and sending out the wrong message to serial defaulters. Doesn't pay the judgment debt, doesn't engage in the costs process....requires the sympathy of the Court - HHJ Simpkiss takes a robust but fair stance and says "No, your p*** taking ends here" (using more judicial phraseology). Males LJ overrules and gives the landlord the green light !

Most Courts would adopt the approach of HHJ Simpkiss. Now they'll be waivering in light of this latest bout of leniency shown by the higher Court and here comes yet more uncertainty for everyone faced with applications of this nature....
