If Wales has an increasing ability to pass separate legislation from England, it will inevitably become a distinct jurisdiction, since practitioners in England will, presumably, not know the local law any more than they do the law of Scotland. This was another issue not thought through at devolution. I am now striking out "and Wales" in draft governing law clauses in contracts for this reason - particularly when the contract can be expected to run for a significant period of time
