Journalists don't have the right you identify, merely an reasonable expectation. A litigant, however, should be provided with timely justice and the HRA provides a right to a fair trial (Article 6 of the ECHR provides a detailed right to a fair trial, including the right to a public hearing before an independent and impartial tribunal within reasonable time) though what the content consists of in any particular set of circumstances may be uncertain. However, the journalist may be able to help with the litigant's right by exposing situations where the court is failing or has failed to provide it. So I don't regard them as necessarily mutually exclusive
