Simple estates do actually work well with DIY Wills and I know that simple tasks that solicitors complete and charge a lot of money for like sending an email is probably where some of the general public get scared that maybe they will be ripped off! Although there are many reasonable priced Will writing services provided by many solicitors, you can’t blame the public for being shy of using solicitors when we all know some of the costs that are charged by some companies for simple tasks! At the end of the day dispensing power laws should be widened to simply ask these individuals for more factual written evidence to give strength to the failed document, in most valid cases there will be more than just that one failed document that proves the testator wishes. England and Wales should have followed advice from Australia years ago, the dispensing power rule is available and working in other countries yet we are still afraid of opening it up in England and Wales! Yes people might have more costs to pay but all that matters is the testator last true wishes are followed. The problem comes from people with failed documents not understanding how archaic the wills act is when testators intentions should always be paramount to an argument
