Robyn Rihanna Fenty, better known as the pop star Rihanna, won a legal action against retailer Topshop when the Court of Appeal ruled that the sale of a T-shirt with her image was an ‘act of passing off’.

Giving judgment in Fenty and others v Arcadia Group Brands, Lord Justice Kitchin said a substantial number of purchasers were likely to be ‘deceived’ into buying the T-shirt believing it was authorised by the singer, and that its sale amounted to lost sales of her own merchandising business.

Topshop lawyers argued that there was no intention to create the appearance of an endorsement.
