The Employment Appeal Tribunal has allowed an appeal by Essex County Council over a finding that it unfairly dismissed Evelyne Jarrett, the most senior black manager at Essex Legal Services by reason of racial discrimination.
The council said the case will be remitted to a new tribunal with new panel members.
Current definition involves a 'notoriously difficult, time-intensive, expensive and uncertain process', lawyers and journalists state.
