Correction to remuneration changes 2001

Owing to a drafting error, the Legal Aid in Family Proceedings (Remuneration) (Amendment No 2) Regulations 2001 (which incorporated the 10% increases announced by the Lord Chancellor to family suppliers) contained incorrect rates for attending without counsel in care proceedings in the county or magistrates court at schedule 1A, paragraph 9, column 3 [2001] Gazette, 29 March 45.

This error was incorporated into Focus 34 which set out the new rates.

Therefore an additional amendment to the regulations has been laid to correct this error.

With effect from 2 April 2001, the hourly rate in county and magistrates court care proceedings for attending without counsel at the trial or hearing of any cause or the hearing of any summons or other application at court, or other appointment will be 71.50 per hour.

This new higher rate applies in both London and the provinces and replaces the incorrect rates of 68.20 (London) and 64.90 (provinces) set out at schedule 1A, paragraph 9, column 3 of the amendment regulations and in the article on page 12 of Focus 34 as mailed out to suppliers.

There was a further error in the table dealing with part 1 Preparation under Schedule 2A: prescribed family proceedings.

Item 6 travel and waiting time in the high court should be 35.75 per hour rather than 33.75.
