The Ministry of Justice (MoJ) has scrapped the Exeter Court Small Claims Mediation Scheme despite its record of achieving settlements in 75% of cases over the past six years. Jeremy Ferguson, one of the founders of the scheme and a consultant at Devon firm Chanter Ferguson, said it was being replaced by an 'untested scheme' of non-legally trained mediators. 'They are being paid by the MoJ so cannot be regarded as independent,' he said. He added that the MoJ had declined offers of assistance from the Exeter team of mediators.
