The Court of Appeal has ruled that the rights of patients discharged and later recalled to hospital under the Mental Health Act 2007 are compatible with the European Convention on Human Rights (ECHR). Schizophrenic Daniel Rayner had pointed to a conflict between the month allowed under the act for referring cases to tribunal and the ECHR requirement for a case to be referred immediately. The court ruled that the secretary of state's duty to 'act with despatch', combined with habeas corpus and judicial review, were sufficient to protect patients' interests.
