I am writing to say how much I agreed with the letter from John Clay in his criticisms of what I term 'the frightened conveyancer'.
The profession is now becoming totally obsessed with often trivial issues involving building regulations, planning and other matters, which conveyancers of a few years ago would have taken in their stride using common sense.
Many members of the profession seem to forget that it is their job to apply a knowledge of land law to the conveyancing process and make pragmatic decisions. We cannot abdicate those decisions in favour of an indemnity insurance policy which someone else is expected to pay for. Purely out of interest, have any of your correspondents ever made a claim under an indemnity insurance policy?
