I cannot claim personal knowledge of the Axa situation, but I can and do disagree with David Wingate's conclusion (see [2004] Gazette, 14 October, 17).
Is it not equally likely that Axa has simply been settling more claims without the need for proceedings to be issued?
If so, claimants are still getting the same amount of damages and their solicitors the same amount of costs as before.
