It is unfortunate that Lord Hutton's rather weird judgment was handed down the day after Lord Falconer, the Lord Chancellor, announced continued judicial independence.
Any suggestion that Lord Hutton faced any pressure to let the government off the hook to continue this independence would be, of course, far-fetched.
Maybe, though, this just subconsciously influenced him.
