Lord Justice Jackson is to be applauded for bringing forward proposals which will so clearly reduce the cost of litigation by providing a cap on success fees, non-recoverability of after-the-event insurance premiums, and fixed fees across the fast-track.
Obviously, he will now introduce his proposals to cap the costs of rent, rates, heating, lighting, practising certificates, compensation fund, professional indemnity insurance, buildings and contents insurance, travelling, stationery, court fees and all those other minor overheads which would otherwise keep on rising. Thus he will achieve certainty, proportionality and above all else that famous ‘level playing field’.
