Fundamental dishonesty and fraud-fighting are not necessarily subjects for much comedy, so Obiter appreciates any attempt to lighten the mood.
Clyde & Co released details this week about how it had thwarted the £81,000 claim of a driver who claimed to have suffered injuries when his car was clipped by a passing lorry while parked on the A13.
The driver of the Porsche 911 Carrera GTS claimed for personal injury, medical treatment and a loss of earnings.
But dashcam footage from the lorry showed that not all was as it seemed. The driver was not, in fact, in the car but crouching in a neighbouring field. It was not disclosed – but was fairly clear from the video – what he was doing.
Presented with the evidence, his solicitors withdrew and the claim was discontinued, with the car driver paying the insurer’s £4,000 costs.
We particularly liked the quote from Damian Rourke, partner at Clyde & Co, who summed up the case thus: 'The dashcam showed him in the bushes. We still don’t know what he was doing there – but we do know he wasn’t in the car. His story fell apart the moment the truth came to light. In every sense, the claim was caught short.’
