Anonymous @ 18/06 6.29pm - Your ‘tests’ for the ECHR won’t be met because the ECHR's role is to exercise judicial influence - not impose legislative solutions. Those solutions are up to individual countries. Dr Victoria McCloud is taking her case to the ECHR because she contends she has been rendered ‘genderless’ i.e. her gender recognition certificate (and other personal documentation) says she is a female - while the way the recent Supreme Court judgment has been construed, - she is a male. The court’s decision will relate to the possible infringement of her human rights. It will be up to the UK to sort out its legislation if the court finds that her rights have been infringed. Similarly people crossing the channel have a right to to claim asylum. The answers to your questions must be grappled with in the UK by legislators - not by an international human rights court.
