According to the ethics report she provided details of the trust arrangements and was told twice that the correct calculation would be at the lower rate. It is unclear which of the firms involved gave this advice.

There was a disclaimer attached that she could or should seek specialist tax advice, and she chose not to.

I am not sure in the value of such a disclaimer where clear advice has been given that turns out to be incorrect.
