I am afraid, Anon 8.38, that is how it will be, or become. If people cannot resolve their differences in the 'civilised' way we have grown up to expect they will 'take the law into their own hands'.

One of the fundamental obligations of the modern state is to protect its citizens from attack from without and to keep law and order within. The denial of justice, which in effect is what these court fees now are, derogates from that. So another form of 'rough justice' will take its place. It is bound to happen. That part of Magna Carta which says that 'to no man will justice be denied' specifically addressed this evil in order to keep some semblance of, well, order.
