Isn't it funny how Judges who were former practitioners, mutter about how expensive litigation is? I wonder what Mr Jackson's average brief fee was?

The same applies to default - frankly pre Woolf it didn't really matter. Do what I say, not what I have done is cold comfort. No one can be expected to run litigation with the ridiculously whittled fees, massively hiked court fees, and astonishingly draconian rules.

I would dearly love to return to the pre-CPR days when things worked, and worked well. Rules had been developed over decades and centuries, yet in less than 20 years we have seen a series of chaotic shambles and gaffes from the MOJ and it's predecessor that have created not just an elaborate set of trip wires, but never ending flow charts of protocols, rules and processes that are as scrambled as they are chaotic.
