As a DDJ I have a real problem about awarding a so called success fee in a case where a 7 year old child was injured where a car driven by her father runs off the road and ends up in a ditch with no obvious cause such as oil or ice. Where is the risk in the case? And why should the child's damages of, say £1500 be reduced by 25%? If the mother, or whoever the next friend is, has done a deal with the solicitors let her pay the "success fee" rather than the child. Unless there is a rule change or a binding decision by a higher court I won't allow it.
