Anon at 08.52 completely misses the point as seems to be the case with the majority of the Judiciary. The success fee is designed to form part of the Solicitors costs and allow them to take on these cases. Would he or she prefer it if the child got nothing because no Solicitor could afford to take on the case? Jackson and the Minister of Justice have combined to produce a system where a commercial level of costs is not recoverable from the party at fault and instead have decreed that there should be a deduction from damages to bring costs up to a commercial level. Why can't the Judiciary understand that?
