I entirely agree with Anonymous at 04.15 that "The whole point of damages is to put the victim back in the position he (or she) would have been in had the negligence not occurred.". Perhaps if damages claims were paid on that basis we would get away from all the nonsense of paying "compensation" for every stubbed toe, late delivery, and alleged whiplash. Last week a fireman was awarded damages as a result of a feint due to the lack of bottled water at a fire scene - three years earlier; how in the name of heaven does that put him back in the position he would have been? As for prisoners being paid compensation for minor injuries; madness.
