The Courts are going to run out of money soon because the fees are too high so no one will be able to afford to litigate Just one obvious false economy of the Government In any event there will be so many family litigants in person that even if people were issuing then there would not be time to hear these petty little claims about conservatories being badly built and the like. These matters apart, Mediation pre supposes that people want to mediate. It is straight forward in family cases as in many ways there is often not a winner and a loser. Those that have genuine contractual or negligence claims that is should not be denied their day in court just because of badly made out fiscal restraint arguments which favour a mediated solution but completely undermine our hard gained common law rights of access to the Courts.
