Hugh James said the number of claims is now rebounding as disgruntled former employees adjust to the new fees.....Emma Burns, partner, said: '.....when they were first introduced it was a shock, but now people are more acclimatised to these fees.'

These statements make no sense. They suggests that the same employees are frequently making claims and, like watching a fluctuating market, are now prepared to 'buy'. But in the time frame we are talking about, any particular employee would only have been considering one claim at most and would have a short window of time to decide whether to pursue it. They either pay the fee or not based upon an individual assessment of their case and personal circumstances. It's a one-time decision. They're not watching the trends or 'coming around' to the idea of paying fees. "Oh, I wasn't happy with paying them last time, but all my friends are doing it so I'll probably pay them when I sue my next employer."
