I forget where I first came across that classic argument that costs should reflect damages, they should be proportionate. I'm reminded of something a senior costs Judge once said when asked what were proportionate costs. He said, "they are more than the losing party wants to pay, but less than the winning party would like to recover". The fact of the matter is Government intervention is not needed, leave it up to the cost judges. Here is a novel idea, reduce the level of negligent treatment then you will not have to pay anything.

I called a plumber out the other day the "damage" to my leaky tap was corrected with a 20p washer. I still got charged the £100 + VAT call out charge. When can I expect a consultation on making plumber fees more proportionate? I suspect around the same time that big insurance decide to insure against a leaky tap.
