In the US, mediation properly administered works time and time again. The failure is in the legal system and mediators who simply don't do enough to promote the virtues of such a private, supervised dispute resolution process. Ordinary people don't understand it and don't know how to get it or whether to trust the people who mediate. You need to make mediation more accessible, understood and trusted by lay people. Rather it remains largely a court annexed process introduced much too late in the dispute resolution process.
