There appears to be a presumption that 'the best' automatically = those who were most sucessful as advocates. I am not convinced that that is necessarily true.
Perhaps it is time to look at the recruiting process. Given that part of the issue is that of dealing with more LIPs, perhaps there should be greater focus on recruiting solicitors, (who tend to have more experience in dealing with people unfamiliar with the law or the processes involved,) as judges, and tailoring recruitment towards the skills now needed for the bench, should be considered.
We should perhaps also consider whether the judiciary should be seen more as a third branch of the profession, with its own professional track, rather than something to which solicitors or barristers switch.
