I saw an article in the paper at the weekend about the increased personal threats to District Judges because of the increase in litigants in person and concerns about Court security. We have a situation whereby if the solicitor messes up then there are vicious sanctions, if the court messes up then there is an adjournment so another fee to pay for another hearing to pay for. Family solicitors now have to provide extensive bundles for every single hearing at great cost which are destroyed at the end of the hearing because the Court does not have the resources to store them or whatever; we have to provide them for litigants in person who are suing our clients at our client’s or our firms’ costs. In personal injury cases the fees are so high that one wonders how they will be paid for by small high street firms on modest budgets. When the small claims limit goes up in personal injury cases, all those litigants are going to have to find out who to sue when they get injured by negligent contractors, or how to obtain details of an insurer from a car registration number, the wonders of the Portal system or how to instruct a medical expert and comply with the protocol, or how to work out their loss of earnings and the Judges are going to have to help them or they will not get justice. The justice system in this country is fast becoming nothing but a farce!
