I have little doubt that his Lordshop is a clever man, but then clever people are also exceedingly stupid as to the groundwork required. He sat in his ivory tower of chambers and when consulted gave "oeders" of what he required, with little regard to the work that might be involved.

Solicitors are at the coal face and are ware of the effort required and not always as bright or knowlegable of "court" matters.

His Lordship should have spent a few years at the coalface, following the orders he dished out and then he might, just might, conceive what is/was involved.

Anyone remember proportionality? Judges would have thought long and hard if their salaries were affected by their orders made in respect of that.

Politicians are even more removed and distant from their wishes.

You don't want high costs, simplify the rules to reflect reality, and requirements handed down. Yes there are abusers, but not enough to warrant the simplistic insanity now being promulgated. Rather tyhan esoteric theory, make the rules etc simple, BUT only after consulting those slaving away at the coalface. He should remember that a lot of the costs are run up because barristers require it. Rarely are their costs hammered.

Oncer told to me by a barrister who became a circuit judge, when a barrister gets his bum on the woolsack, he forgaets all reallity he learnt whilst getting. Apposite, your Lordship?
