The argument is harmed, not assisted, by party political or knee-jerk comments. It was, after all a Labour Government which cleverly 'modernised' the judiciary by making them managers of budgets and resources. Events have shown that to have been a significant and, in my view, dangerous step.
On the narrow point as to who is best placed to decide on the 'public interest' there is a case for saying politicians who must place themselves before the electorate are in a better position to answer this particularly difficult question. It is not unreasonable to suggest decisions be taken by those with responsibility to those on whose behalf the decision is made, subject to independent scrutiny to ensure it is lawful on standard Wednesbury grounds. There are those who might disagree but a debate among lawyers should be conducted logically, non politically. I must say I am also not too sure how contributions from Anonymous people is satisfactory in this debate.
