I have recently had to bring proceedings against my builders, this was after they ignored me, their insurers ignored me and left me no option.

The cost was £105, a trifling amount to me but a significant expense to many, if they ignore the Judgment then I'll have to seek a warrant of control and then instruct bailiffs: again an affordable expense to me but not all.

If that fails, then we're going down the route of declaring the company insolvent and the Third Parties (Rights Against Insurers) Act 2010 and even if the average LiP could afford the fees I doubt whether they could do this without assistance.

None of this would be economical if I had to pay legal costs and as such I would in effect have no remedy.

The (new) Court fees and proposed restrictions on inter partes costs simply magnify this unjust situation and it is an affront to our traditions and to the rule of law.
