Yes, quite correct, Raynor, but if you were non-suited you had the option, at any time before judgment and after paying the other side's costs, of restarting after getting 'your tackle in order' if for some reason it was not. That right was abolished by Woolf for some reason I have never understood. I have to say it was not a remedy I ever saw used and, I suspect, had fallen into disuse. I am not sure where or when Woolf did this, but I know he did it at about the time of his reforms, if not as a part of his reforms.
