Anon at 6.01 pm - the key to your comment is 'if the mechanic notices'. Does that mean he should ask you questions about your brakes? Must we ask questions and investigate beyond what is obvious?

Client - "How much will you charge to prepare a bundle for me if I give you all the documents in this simple case?"
Solicitor - "Well, for preparing the bundle £500, but for thoroughly investigating your case and advising you on your prospects of success so you know what risk you run on costs, another £5,000".

The important part of this judgment is the judge assuming that, because the LIP had been given some advice by a solicitor, all the issues relevant to the point in question will have been explained. The reason is that whilst most judges are keen for LIPs to be given some kind of steering by a helpful lawyer, they aren't willing to take the idea to its logical conclusion.
