Given the adversarial nature of litigation it amazes me that the current view appears to be that it should be conducted as though each side, and their lawyers, should all be friends together, failing which costs sanctions will follow. This is nonsense, but it does echo the levels of weak, risk averse and non-adversarial advice that I perceive to be prevalent within the profession at the present time.
