Theoretically, I agree now is the time to engage with insurers on CMCs and cold-calling. But lets be realistic, the insurers wont want to. They want more than cold calling and CMCs banned (that's a piffly saving compared to £5k SCT). As one commentator notes, even if all claims were scrapped, ABI may still say reforms had not gone far enough. Lets not forget motor insurance is compulsory for drivers so in terms of a market place, insurers don't have to generate custom, rather just fend off their competitors by way of gimmicky adverts and cuddly toys.

Rather, Law Soc, APIL and A2J etc. should now take the lead in lobbying for the strategy of reform. Lets set the agenda - how should the process be, what should costs be?, etc. We will never see eye to eye with insurers. Why pretend? There is a clear conflict of interest.

They are more proactive, have the funds / mouthpiece and have powerful friends in Govt. Why would they bother to engage with us? To ensure our continued existence albeit on sensible costs / to ensure innocent victims are appropriately and fairly compensated. Laughable - just look at 3rd party capture.
