The discussions about whether the referendum was advisory or not are interesting but irrelevant. The court has ruled that, constitutionally, Parliament must be involved in the exit process, and it cannot be done by exercise of the Royal Prerogative. The Supreme Court may opine otherwise, but if not, or until it does, using the Royal Prerogative to serve notice under Article 50 would be unconstitutional, and, under the terms of Article 50 itself, therefore ineffective.

It is ironic that those most keen to throw off EU law and have British law seem to be the loudest ones decrying the solely British law decision about the correct process. Surely this is what was voted for?
