Yes , but . . .

Why would anyone listen to or read the defence of a retired judge? A fair few wrote to them. The DM seems to have buried the one it received. An immediate robust reply from the judges' representative within the government would be much more telling - I hope.

Judges are upset by this vitriol as Lord Judge - no shrinking violet as I know - said in an article last week. No doubt their families are more so.

The Supreme Court being supreme can, I suppose, come to a different decision and can take into account that the electorate has spoken on the issue when weighing up the constitutional niceties if it wishes. For what it's worth I'm expecting a split decision.
