The fact that his figures compare favourably to those in the consultation for clinical negligence cases is not a good thing because those figures are based on a hopelessly flawed premise, namely that the hourly rate in clinical negligence is the same as those on the fast track standard basis. I've never seen any clin neg lawyer claim - or be limited to - such a rate. If Kerry's rates are therefore based on the same principle, they, too will be hopelessly flawed.

On another note, why are they bothering? The Justice Committee report makes it clear that the reforms have failed on 3 out of 4 of its intended aims and was heavily criticised for the 1 it did succeed on (reducing legal aid costs). Continuing to pursue the reforms will not make it better. This is just the little boy putting his finger in the damn whilst it floods all around him, surely?
