When I was taught family law at university (basically the current system) it was emphasized that this was not fault based; the grounds for divorce were irretrievable breakdown of the marriage, as evidenced by one of the 5 factors of adultery, behaviour, desertion, 2 years' separation (with consent) or 5 years' separation (no consent). But as Anon on 18.2.17 @ 11:10 indicates, it has become "fault based" because the quickest routes are adultery and unreasonable behavior, both of which lend themselves to point scoring, rancor and finding fault with the other party. Clearly the judge in the recent case didn't regard the "behaviour" as sufficient evidence of irretrievable breakdown with the astonishing result that husband and wife are condemned to live out a husk of a marriage in resentment and loathing. Anon's suggested adjustments seem eminently sensible.
