In a different, though equally controversial context, 25 or more years ago I heard an infant PI settlement in a clin neg case. The injuries were scars caused in a forceps assisted delivery. Liability was not in issue. Damages were low.

Talking to his father, he told me that his son was not right. I was uncomfortable and refused to approve the settlement. Father said he was seeing a specialist to whom his GP had referred him.

Over a decade later a very large file crossed my desk. It was the same case. Briefly, inevitable brain damage had been exacerbated by the negligence. Damages for the exacerbation were approved at just under £1m.

Today, the scarring alone would be close to £5k.

Why am I concerned? I'm going to be £40 better off after all.
