The savings to the insurers will be far in excess of the mythical £40 per policy. There will be very few LIPs as I doubt many will be able to pay £216 up front for their medical report, assuming they can navigate the midis, the portal and medco more so if you have been off work for a couple of weeks, have been on SSP and you are a JAM! the insurers know this and the government do so as well! If I were an insurer, even those who do seek to claim I would simply deny fault and invite the injured person to stump up more cash to issue proceedings, to navigate disclosure and exchange of statements and to pay for the hearing fee. Given I suspect most won't bother if their initial claim is rejected then the savings will be massive.
Those who do sue will of course only have to pay the issue fee appropriate to the value of the tariff and the hearing fee resulting in perhaps a DJ dealing with a LIP arguing against a claim for contrib for the princely hearing fee of £25. The financial loss to HMCT will be enormous and no doubt lead to more court closures.
Oh, and if the medical report fee is £216 for a 3 month injury resulting in damages of £225 when does the cost become disproportionate?
