I don't condone CMC's breaking the rules or solicitors turning a blind eye to CMC's who do break the rules. However, CMC's who data mine properly opted in data are doing nothing wrong legally or ethically. If I indicate that i want to be contacted about a claim via a web form / cookies / survey etc then what is wrong with a CMC who has purchased my data contacting me? The answer of course is that they have done nothing wrong at all. The MOJ aren't bothered about it. Oliver Heald said as much a couple of weeks ago. Some of the commentators below are quite right when they say some of the biggest firms in the land receive claims from CMC's who mine big data and why shouldn't they?
