It is interesting to read Russell Conway's post, especially as at the time of writing, 96 people have indicated their support for the sentiments imparted. However, in my view, the client was approached in completely the wrong way. A complex (but fascinating) legal problem was presented which would likely result in a hearing estimated to be of two days duration. The solution? A free 30 minute interview. During that 30 minutes, all that could realistically be achieved would be providing an overview of the process, an explanation of the risks involved and an estimate of the costs.

The client would then be better equipped to understand the reality of the costs associated with her contemplated action balanced against the perceived benefit. The practice would be less likely to receive a complaint. Risks need to be assessed before processing instructions (Lexcel 5.12).
