Jonathan, I must respectfully disagree. I know as a fact there are literally hundreds of cases where firms, possibly victims of referral fee scams themselves, pursued claims where they acted without direct instructions from claimants, instead relying on authority provided by CFA sign up agents. That's why I'm slightly surprised the test cases picked didn't exhibit that evidence, as there was so many examples. All the talk was that there was 10s of millions at stake here if claimants solicitors ended up having to repay. Clearly there cannot have been thousands of cases where the claimant decided not to proceed on liability admitted cases, without an alternative explanation. Also, there aren't such volumes of cases now that are dropped at Stage 1 with liability admitted, so doesn't that suggest that "the money" was the crucial factor?
