He's missing the point.

Fixing costs above £25k is easy. Fixing costs below £25k is the difficult part, because in the majority of med neg cases below £25k the costs amount to a significant proportion of damages. Fix such costs so that they become "proportionate" and most clients will have to pay for representation. But in most such cases the solicitor costs are exceeded by expert fees and Counsel's fees for a trial.

I can foresee solicitors utilising medical agencies far more readily and claiming the increased disbursement/expert fees instead of increased costs. Another round of costs wars approaches.
