The MTC were changed because insurers pressed for it. The reason for that was that they might allege that a member of a firm was dishonest and therefore not entitled to cover, while simultaneously having to pay for the defence of the disciplinary investigation into the same matter. (Insurers can't withdraw cover until there is a finding or admission of dishonesty.)
