Missing from the court judgement and the above comments is that all parties in all cases must be of equal standing. The council is a corporation which is a dead thing. The defrauder is a man or woman, a living thing and therefore of higher status. All councils ignore this when chasing people who refuse to pay council tax. Were the councils to operate in a lawful manner, I would pay my council tax.
The council solicitor obviously operates outside the law as this case shows.
My council solicitor also operates outside the law. She is the monitoring officer and has a statutory duty to ensure the council operates within the law. The law dictates that a committee cannot determine planning applications. The application must go before the full council. There are two projects where I live both determined by a planning committee each costing over £50 million. Each have yet to go before the full council.
