Surely CMCs won't be banned, as they allow consumers to instruct seemingly low cost outfits with few questions asked, thus making a claim as easy as renting a car. Banning them means admitting that the combination of human ingenuity/stupidity and perceived injury is actually rather complex (as evidenced by the development of the common law) rather than a simple commodity like house insurance.

That would never do. It would be like admitting that buying a house is rather an important transaction and needs to be done properly, and is nothing like buying a car or even a can of beans. Oh, hang on a minute....

In the 1980s I handled many claims for an upmarket travel company. I don't specifically recall any food poisoning claims, but some of the claims - from people who in the 1980s could afford to spend £3000 on a fortnight's holiday - were bordering on the bizarre. My favourite was the guy convalescing from open heart surgery who complained that the camping safari holiday he booked was too arduous for his condition and he should have been specifically warned... (needless to say he didn't mention his condition until he got home).
