The principle of charging fees for the use of the courts was not in issue. Courts have always done that.
The issue is whether the fees have the effect of creating a significant barrier to accessing justice.
The Supreme Court found that what the government had done with these fees was to create an impediment to access justice. The judges were still there, but the litigant couldn't get to them.
It is a beautifully crafted decision. The only pity is that those responsible have shuffled off the stage and so are no longer there to face the cabbages.
